Recall Management enhances dealers’ ability to identify vehicles with open recalls, avoid penalties, and protect the lives of their customers and those sharing the road with them.

Recall Management runs automatically in the background, checking the entire dealership inventory at regular intervals to call dealers’ attention to recently issued recalls. The program uses easy-to-identify icons to alert sales and service staff to unaddressed recalls on the vehicle they are working on, checking in, or trying to sell.

This comprehensive recall software leverages extensive recall data from direct relationships with vehicle manufacturers, a dedicated research team, and other methods to ensure dealers have the most up-to-date information. Currently, more than one in four vehicles on the road have an open recall. With Recall Masters’ database of more than fifty leading providers supporting forty-six brands, NHTSA-mandated safety recalls and service bulletins issued by manufacturers are constantly monitored.

The announcement comes as the U.S. federal government is taking new steps to protect automotive consumers, including the introduction of the Used Car Safety Recall Repair Act in 2021 proposing financial penalties from the government and OEMs for dealers who are noncompliant with established safety standards.

Currently, selling a vehicle that does not comply with established safety standards can result in the NHTSA levying a maximum civil penalty of nearly $21,000 per offense.

Recap of 2020 Recalls Reveals Impact of Pandemic on Compliance and the Continuing Threat

Despite a depressed manufacturing schedule due to the pandemic, 2020 NHTSA-mandated and OEM Voluntary recalls remained stead, adding to the enormity of the recall crisis

 

Laguna Hills, CA, May 12, 2020 — In its fourth “State of Recalls” report, Recall Masters, Inc., the automotive industry’s leading provider of recall solutions, revealed that more than 29.3 million affected vehicles were accounted for in 278 recalls mandated by the National Highway Traffic Safety Administration (NHTSA) in calendar year 2020. Another estimated 266 “voluntary manufacturer notice” campaigns affected the passenger cars and light trucks framed in this report. While many vehicles have more than one defect present, the 2020 total of 83.2 million affected vehicle recalls translates to more than one in four vehicles on US roads with at least one open recall. With an estimated 286.9 million registered vehicles in the country, the threat to drivers and passengers is greater than ever.

In a year littered with fallout from the COVID-19 pandemic, automotive manufacturers fell far below annual production estimates.  Throughout the United States, new vehicles are a scarce commodity on dealership lots due to a worldwide shortage of semiconductors.  The pandemic caused the closure many of the few factories that produce these processors, bringing the OEMs to a grinding halt on new vehicle production.  Those computer chips have become vital components in vehicle operation, as cars become more like computers than machines.  Limited silicon chip production now forces OEMs to compete with other industries that build more in-demand products such as ventilators, computers and mobile phones.  The shortage of new cars has driven up prices for pre-owned vehicles, which were already in demand prior to the pandemic.  Newer pre-owned vehicle costs limit available profit for dealers, who now turn to older vehicles – 29% of which have a dangerous an unrepaired recall.  New vehicle availability might not return to pre-pandemic rates until late 2021.

“While used cars with an open recall are sold at a record pace, recalls are an even bigger threat to consumer safety,” explains Sean Reyes, Chief Marketing Officer at Recall Masters.  “In the face of falling sales revenues, franchise dealers turned to fixed operations to close the gap, repairing almost three times more same-year recalls as in prior years.  Unfortunately, this recall compliance data can’t negate the annual growth rate.  We’re just piling unrepaired recalls on top of previous years’ unrepaired recalls, but with the additional risk of used cars that are not exiting the market.  Prior to the pandemic, many of these vehicles would be scrapped.  Now, with limited availability of new cars and newer pre-owned vehicles, consumers are repairing these older vehicles at independent shops where recall repairs cannot be performed.”

Automotive recalls drew concern from consumer groups and legislators in recent years after dangerous Takata airbags caused several deaths and injuries. The Takata airbag problem lingers menacingly for 2020, as 32 airbag recall reports affecting almost 7 million total vehicle recalls keeps close pace with previous reported campaigns. Many of these faulty airbags were installed amidst a parts shortage, knowing that they would eventually have to be replaced.  Software and electronics recalls led both total campaigns (77) and total vehicles affected (7,541,325).  Vehicle features such as lane correction, auto-braking, in-cabin electronics, auto-parking and other driver-assist functions are heavily dependent on electronic components and software.  These electronic components are usually encased in plastic and are more susceptible to environmental and driving conditions.  Much like your laptop or phone, software requires patch updates.  The increase in the Software and Electronics category is causing Service Directors to redesign their service bays for a wave of high-tech recalls.  The 2020 State of Recalls Report also breaks down recalls by OEM and provides additional analysis like risk to consumers, vehicle system defect source, and vehicles counts for each defect category.

“This report takes a much deeper look at vehicle defects that include NHTSA-mandated recalls and a variety of other factory notices,” describes Reyes. “While this is the most comprehensive report of its kind, we acknowledge the gaps in data that come from how factory notices and collected, tabulated and scored. The automotive industry, consumer safety groups, legislators and consumers look to Recall Masters to provide them with a better understanding of vehicle defects and how to solve the recall crisis, which means more data than what the government currently provides. These voluntary manufacturer notices are not regulated and can range from typographical errors in the owner’s manual to defects that are on their way to becoming NHTSA-mandated recalls. We would all benefit from centralizing that data so that reporting can be more accurate. It’s going to take a collective effort, but we’ll get there in time.”

To date, the State of Recalls is the only annual report to publish voluntary manufacturer notices. Many in the automotive industry and consumer safety groups incorrectly assume these notices do not pose risk to consumers, like those recalls mandated by NHTSA. However, the gaps in time between reporting a defect and the investigations that follow, can leave vehicle owners vulnerable. Recall Masters tracks a vast number of these notices, providing risk scoring for the industry and consumers, along with other data points that can help dealerships appraise off-brand vehicles they might acquire at trade-in or at auction.

“We believe the consumer needs to know.…and dealerships need to know,” notes Reyes. “One of the leading reasons recalled vehicles go unrepaired is because owners and off-brand franchise dealerships don’t know about the recall. The list celebrates the entrepreneurial success of local businesses experiencing exponential growth. 

Qualifying companies must be based in Orange County, be privately held and have seen a minimum of at least 15 percent sales growth over a two-year period beginning on June 30, 2016. Recall Masters topped the list with an impressive year-over-year growth.  Revenue for the 12 months through June topped $6.4 million, skyrocketing 531% over two years. With more than 1-in-4 vehicles on the road today with an open recall, Recall Masters has taken on an impressive challenge, most infamously driven by Takata airbag recalls.  Vehicle recalls were featured prominently in the media a few years ago when the Takata airbag recalls were first announced. Since then, at least 15 drivers and passengers in the U.S. (23 total worldwide) have died, with more than 250 people injured because of the airbag inflators. Worldwide, 23 individuals have been killed by exploding airbags. These faulty Takata airbags use ammonium nitrate to inflate the device in the event of a crash. However, after extensive testing, it was discovered that the ammonium nitrate can become unstable over time, leading to inflators exploding with violent force. According to the results of the ensuing NHTSA investigation, if the defective airbag ruptures, it can spray sharp metal fragments directly at the driver and passengers, increasing the risk of death or injury.

Recall Masters’ Christopher Miller warns auto dealers they could be easy targets for aggressive plaintiffs’ lawyers; offers advice to keep them safe

 

Aliso Viejo, CA, December 5, 2017Recall Masters, Inc., the leading provider of automotive recall news, data, training, and communications, today announced that it recently helped a large dealership client quickly fend-off a lawsuit related to recall communications.

The plaintiff alleged that she received text messages sent by Recall Masters on the dealership’s behalf that were not in compliance with the Telephone Consumer Protection Act (“TCPA”). Recall Masters provided information to the plaintiff’s attorney about the extensive preventative compliance audits and painstaking steps taken to conform with TCPA guidelines, which lead to the plaintiff promptly dismissing the case.

According to Recall Masters’ President, Christopher Miller, while this lawsuit was quickly handled by showing the plaintiff that no laws were broken, the industry will remain under scrutiny and dealers should take compliance matters seriously. “In recent years, many manufacturers, dealers, and their solutions partners, have become the target of criticism and litigation related to text messaging/TCPA violations, deceptive advertising, and fraudulent claims,” explained Miller. “Attorneys representing plaintiffs claim that dealers are recklessly sending marketing calls and texts without proper consent under the Telephone Consumer Protection Act. On top of that, dealers continue to use aggressive, fear-inducing messaging attempting to coerce consumers into visiting their dealership. Upholding the highest ethical standard in our messaging and steadfast compliance with all laws has been and remains a number one priority for Recall Masters. And, in this case, those compliance efforts paid off for both Recall Masters and its client,” Miller added.

Recall Masters helps dealerships send consumers recall notices through multiple channels including postal mail, text messaging, emails, social media and phone calls, and goes to great lengths to comply with the TCPA, reasonable interpretations of FCC orders related to it, and various federal and state laws. Because of its heavy investment in compliance, Recall Masters was able to help its client inform the plaintiff on its efforts, leading to a reasonable dismissal without prejudice.

Recall Masters supported its client by providing documentation related to its compliance efforts. It also provided information about the TCPA’s exemption for calls and texts communicating information affecting the health and safety of consumers, which would reasonably include recall notifications. Recall Masters also demonstrated how it uses, out of an abundance of caution, a manual system to deliver its text messages with live agents personally interacting with every consumer scheduling recall repairs.

The National Highway Traffic Safety Administration (“NHTSA”) states that in 2016 there were over 900 recalls affecting 53 million vehicles. Over 25 percent of the vehicles on the road in the United States are operating with an unrepaired safety recall. “Millions of people every day are riding in or driving next to a vehicle with a potentially serious defect at a significant cost to public and personal safety. Although manufacturers are required to notify consumers of defects, dealers are often in a better position to engage with consumers, but lack the knowledge and resources to send recall notices on their own,” said Miller.

According to recent reports, more than half of Americans have ditched landlines and only use cell phone communications. Statistics also show that text messages have a 99 percent open rate and 95 percent of those text messages are read within 3 minutes of being sent, according to Forbes. The data clearly supports just how effective text messaging is as a communication channel. What’s more, in a September 2017 survey of consumer attitudes conducted by Recall Masters, 25.3 percent of respondents stated they would like to receive information about a recall on their vehicle “by any means necessary.”  And 8.9 percent stated that “text alone” should be the sole channel of communication. However, the standard means of communication for many manufacturers are phone and mail.

“Consumers are often unaware that they are driving unsafe cars and multi-channel outreach is critical to getting that safety information into their hands. Such informational messages may alert the consumer to the fact they have an open recall and either provide additional information about the recall, or instructions to contact the dealership’s recall department for information and to set up service,” said Miller. “In the search for increased recall completion rates, we can’t ignore how consumers want to receive these notices. Consumer habits and preferences have changed. How important are potentially life-threatening recalls to an individual’s safety? Considering that the national average for car ownership is almost one per person, and that Americans logged 3.22 trillion miles on the road in 2016, I’d say that recalls affect a pretty big chunk of the population,” Miller added.

The recent lawsuit isn’t Recall Masters’ first time helping its clients overcome TCPA concerns. In recent years, Recall Masters has aided about half a dozen clients successfully in responding to compliance-related complaints.

“We believe that effective communication can save lives and dealers need to be better educated about how to correctly do this,” Miller stated. “The bottom line is that the current recall epidemic, which is set to continue for the next decade or longer, will lead to more dangerous driving conditions if modern, more effective, solutions are not employed. Legislators are ‘up in arms’ about low recall completion rates, but have little understanding of what to do. And far too frequently consumers don’t even know the recall exists. A multi-communications strategy that also employs texting will absolutely increase recall repair rates, if used correctly,” Miller stated.
